ANALISA HAK GENDER TERHADAP FENOMENA CHILDFREE DALAM PERSPEKTIF MAQASID SYA’RIAH

The relativity of rights makes what is not generally justified when associated with rights, which is contrary to the definition of rights in Islam. Gender rights that make decisions for childfree causes a polemic in understanding gender rights in the wider community and whether in life the most important priority is a right that can abort other things. The purpose of this research is expected to be a contribution to ideas related to issues of gender rights and the childfree phenomenon that exists in society. In this study using a method that is normative. The research approach used in this research design is normative law. The technique in collecting data in this study was a literature study and for the data analysis method in this study, namely descriptive analysis. The first thing that is highlighted in gender rights is their non-absolute nature, in which in Islam the rights attached to a person are only entrusted which are not absolutely absolute. Mistakes in understanding gender rights make a person base his decisions based solely on egocentricity which is not in accordance with Islamic law, the childfree phenomenon that if only a choice is not based on syar'i then the law is unlawful because such as choosing is not in accordance with nature and is not in line with the goals of marriage in Islam.
