Abstract

The administration of government in a democratic state requires clear limitations on governmental power to ensure that every governmental action remains within the framework of law and constitutional principles. This study aims to analyze the role of Constitutional Law in regulating and limiting governmental authority, as well as examining the legal implications arising from government policies that are inconsistent with the principles of the rule of law. The research employs a normative juridical method using statutory and conceptual approaches. Data were collected through library research involving primary, secondary, and tertiary legal materials and were analyzed qualitatively. The findings reveal that Constitutional Law serves as a fundamental instrument in maintaining the balance of power through the application of the rule of law, constitutional supremacy, the principle of legality, and checks-and-balances mechanisms. Furthermore, government policies that conflict with constitutional provisions may result in legal consequences, including the annulment of legal norms and the imposition of accountability on the officials concerned. Therefore, strengthening constitutionalism, harmonizing legal regulations, and optimizing oversight mechanisms are essential prerequisites for establishing democratic, accountable, transparent, and citizen-oriented governance in accordance with the mandate of the 1945 Constitution of the Republic of Indonesia.
